Thank you for choosing to shop with Eugene Toy & Hobby. Below you will find an overview of our 'Terms & Conditions' which is set forth to protect us and you in regards to how you shop with us online. These Terms & Conditions are due to recent changes in regards to how eCommerce websites operate and we felt it was necessary to provide you an overview of how orders are handled. Please read the information provided below at your convenience before using www.eugenetoyandhobby.com ("the Site") operated by Eugene Toy & Hobby ("us", "we", or "our").
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions.
Due to the new credit card legislation that went into affect in October 2015, we can no longer take payment information over the phone. We know this is quite upsetting to some, but we are still happy to help find a way to pay for your items, especially since we do not have our entire store inventory online yet. If you know of an item and you don't see it available for purchase on our website, you can give us a call at (541)-344-2117 and we will gather your requested items and then send you a PayPal Invoice to help pay for your order. A PayPal Invoice is a safe and easy way to pay for your items and the invoice is emailed directly to you and you can either pay with your PayPal account or a major credit card. If you prefer not to give your credit card information over the Internet, please contact us in regards to sending us a check as we sometimes accept these, but we have to wait for the check to clear before we send out any items. The time for a check to clear usually takes 2-3 days.
Credit Card Processing
We accept all major credit cards online, along with PayPal. At thsi time, we currently utilize PayPal as our payment processor utilizing their Advanced Payment Gateway. This payment gateway is highly secure and features fraud detection. Therefore, if you receive a payment error while making your purchase, it may be that the credit card credentials you entered on the Checkout page do not match what your credit card company has on file. You have up to three attempts to enter the correct information that matches your card before your order is void indefinitely. If this issue does occur, you will need to wait 30 minutes before PayPal will accept your order.
Web orders are typically shipped out within 1 to 2 business days unless rush shipping is selected. However, there may be times when orders will take longer to ship out due to inventory shrinkage. We will contact you alerting you to the situation, ship out the items we do have in stock and the remainder of your order when those items come in at no additional cost.
ALL web orders that are associated with a freight forwarder shipping address will be canceled due to the possibility of fraud.
Out of Stock Items
There may be times when items on this website are listed as "In Stock" but are in actuality "Out of Stock" due to reasons outside of our control, such as shrinkage (theft), an item being placed on a temporary hold by an "In-Store" shopper or our live inventory sync system lagging behind "In-Store" vs. "Online Sales" purchases. We will contact you the moment we know we will not be able to fulfill your order in regards to issuing a credit or refund.
The majority of web orders are fulfilled from our warehouse or Eugene store, although there may be times when an item you purchase from our website is fulfilled by a third party, which in most cases is by the manufacturer or the distributor of the product. If your order is fulfilled by one of our shipping partners, there is no additional costs to you and if you decide to return an item shipped from one of our shipping partners, simply contact us and we will provide you with our return address.
Shipping & Handling
Once an order has been marked as "shipped", it cannot be canceled for any reason. Orders are shipped either by USPS or FedEx. After your order has been completed, you will receive a carrier tracking number. If you would like to leave shipping instructions, such as signature confirmation, please leave this in the "Comments" box at checkout.

For in-store pickup orders, please wait until you receive a notification email stating that your order has been 'Completed/Shipped.' When picking up your order, please present your order #/receipt to one of our associates at the front counter.
Orders should be pick-up within seven days of purchase. If an order is not picked up within seven days, we will contact you directly asking if you would like us to hold the items for a longer period or ship them to you for a small nominal fee. If we are unable to contact you, your payment source will be refund the full amount within two to three business days and the items will be return back to stock. If you need to extend the pick-up window time period, please let us know in the 'Comments' section when placing your order or by calling us at (541) 344-2117.
Eugene Toy & Hobby wants you to have a great experience with the products you purchase from us. After all, we sell fun stuff. However, when something goes wrong, we want to make sure that you receive the satisfaction you deserve as quickly and painlessly as possible. Unfortunately due to the technical nature of many of the products that we sell, we are not able to process all of the returns for defective merchandise here at the shop. Many items, especially electronics, must be returned to the manufacturer for warranty repair or replacement. Only the factories have the expertise to determine what the actual problem is and the way to address the problem in the most efficient manner.

At any time, we may cancel an order if we believe it was fraudulent. Orders will be cancelled when we notice suspicious addresses such as freight forwarder addresses, discrepancies in billing and shipping address and fake phone numbers. We will of course contact you prior to cancelling an order, but if we are unable to get a hold of you, your order will be cancelled and the payment method reimbursed.

Due to our recent entry into the world of e-commerce, this site may occasionally advertise goods for sale at a lot less than the intended price in error. Orders for these products may not be fulfilled and the price of these items will be refunded back to you based on your payment method.
The Site and its original content, features and functionality are owned by Eugene Toy & Hobby and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Oregon, United States of America, without giving effect to any principles of conflicts of law.
Changes To This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement, or any changes to this Agreement, do not use, access or continue to access the Site and discontinue any use of the Site immediately.
